GENERAL TERMS AND CONDITIONS OF BUSINESS

1. Scope of Application

1. Each time the img2geo platform is used, new contractual relationships are established between the user and the operator of img2geo on the basis of the applicable GTC.

2. Service description of img2geo

2. img2geo is an Internet platform that enables users to determine possible geographical estimates from images. These estimates are merely hypothetical and do not claim to be correct. The mathematical models behind the technology used are based exclusively on chatbots or language models and can only create assumptions and estimates with probabilities.
3. img2geo does not guarantee that the website will be available at all times or that it will be free of technical faults. There is no legal entitlement to permanent, free use of the exchange.
4. Particularly in development stages (initial and subsequent developments), there may be technical failures or restrictions on the use of the platform. img2geo always endeavors to ensure the full availability of the platform.

3. Login/Password

5. When registering, the user is obliged to provide truthful information and to inform img2geo of any subsequent changes without delay (if provided: online).
6. After registration, the user can manage his data and requests for quotations. The user can request the deletion of the registration at any time, provided that the deletion does not prevent the processing of current inquiries.
7. The user selects a member name and password when registering. The user can log in with this data once access has been activated. It is the user's responsibility to ensure that the user name does not infringe the rights of third parties, in particular name or trademark rights, and does not offend common decency.
8. It is the responsibility of the user to ensure that the access data to img2geo and the use of the services available on the portal are carried out exclusively by the user himself or by the persons authorized by him. If it is to be feared that unauthorized third parties have obtained or will obtain knowledge of the access data, img2geo must be informed immediately at the e-mail address support@img2geo.com; img2geo will then block access. In addition, the user is obliged to change his password immediately.
9. The user undertakes to keep his access data (if these exist at all or have been created - in the initial phase of the website a login or registration is not yet possible) secret and to protect them against unauthorized use by third parties. The password may not be passed on to third parties. The user is liable for any unauthorized use of his account made possible by his conduct, insofar as he is at fault.
10. The use of the account for the sending of mass e-mails (spamming), e-mail bombing and any other form of advertising or marketing messages is not permitted and obliges the user to pay compensation for any resulting damage.
11. img2geo is entitled to revoke the access authorization at any time by blocking the access data without the need for special reasons.

4. Obligations of the user

1. The user is not permitted to upload images that violate legal or contractual rights or offend common decency. Impermissible actions in this respect may include the use or uploading of images:

Images that infringe copyright, trademark law or other intellectual property rights; these are or include:

• Decoding/decryption tools, decryption materials and cracking software;
• Downloadable media;
• Music, movies and photos;
• Replicas and counterfeits;
• Dealing with items that allow copy protection to be circumvented;
• Images with sexual content;
• Offensive and offensive images;
• Images of official identification documents and licenses;
• Images of tickets, airline tickets, admission tickets;
• Media harmful to minors;
• Body parts and mortal remains of people;
• Mailing and address lists and personal information;

2. This list does not claim to be exhaustive and serves solely to supplement and illustrate the prohibited images in section 4.1.
3. As just explained in section 4.1, photos are protected by copyright. The user may therefore only post images for which he or she holds either a copyright or the right of use that justifies the specific act of exploitation.
4. Even if rights exist in favor of the user, such as making photos publicly accessible, it cannot be ruled out that the specific type of publication in favor of persons depicted violates the right to one's own image. img2geo therefore expressly points out to the user that the consent of all persons appearing in published images must be obtained before publication, insofar as the right to one's own image may be violated.
5. In the event of a breach of the obligations listed above in sections 1 to 4, img2geo is entitled to block the user account or access by means of other technical methods without observing a period of notice. img2geo is also entitled to terminate the user contract without observing a period of notice or to exclude the user permanently.

5. Indemnification

1. The user shall indemnify img2geo against all claims asserted by other members or other third parties against img2geo due to infringement of their rights by actions and content carried out by the user. The user shall bear the costs of img2geo's necessary legal defense, including all court and lawyer's fees in the statutory amount. Necessary legal defense costs are those that serve to defend against claims brought with sufficient prospect of success. The user may assert the defense of contributory negligence.
2. The user is obliged to provide img2geo immediately, truthfully and completely with all information necessary for the examination of the claims and legal defense in the event of a claim by third parties.

6. Liability

1. img2geo shall be liable without limitation for damages caused by img2geo or by its legal representatives, executive employees or simple vicarious agents intentionally or through gross negligence.
2. In cases of damage caused by slight negligence, img2geo shall only be liable if it concerns essential obligations arising from the user relationship, which make the execution of the contract possible in the first place and on the fulfillment of which the user may rely (“cardinal obligations”). In such cases, img2geo's liability shall be limited to the foreseeable damage typical for the contract.
3. The above limitation of liability shall not apply in the event of fraudulent intent, in the event of bodily injury or personal injury, for the breach of guarantees and for claims arising from product liability.
4. Otherwise, img2geo shall be liable - on whatever legal grounds - in accordance with the provisions of the law and these GTC, with the proviso that liability for all cases of slight negligence is excluded.
5. The limitation of liability shall also apply to damage caused by a legal representative or vicarious agent of img2geo.
6. The user must exercise the care required in traffic to ensure that files or programs transmitted and/or used on the platform are free of viruses.
7. Although img2geo always endeavors to keep the Internet portal free of viruses, img2geo does not guarantee freedom from viruses. Before downloading content, the user shall ensure that appropriate security measures and virus scanners are in place for their own protection and to prevent viruses on img2geo.

7. Data protection

1. Data when using the platform

We collect and process personal data only insofar as this is necessary for the provision and use of our platform. Personal data is any information relating to an identified or identifiable natural person.

2. Data when using the platform

The following data is processed when using the platform

• Uploaded images
• IP address
• Timestamps of uploads and analyses
• Information about the devices and browsers used

3. Data during registration

We collect the following data during registration:

• User name
• e-mail address
• Password (encrypted)

4. Data processing using AI methods

The uploaded images are processed by AI methods to determine geographical assessments. This processing may include the following data

• Recognition of objects, locations and patterns in the images
• Geographical coordinates and location information
• Image metadata

5. Purpose of data processing

We process your personal data for the following purposes:

• Provision and operation of the platform
• Enabling image analysis and geographical assessment
• Improving our AI models and algorithms
• Communication with you (e.g. for support requests)
• Fulfillment of legal obligations

6. Legal basis for data processing

Your personal data is processed on the following legal basis:

• Art. 6 para. 1 lit. a GDPR: Consent (e.g. during registration)
• Art. 6 para. 1 lit. b GDPR: Contract fulfillment (e.g. user contract)
• Art. 6 para. 1 lit. c GDPR: Fulfillment of legal obligations
• Art. 6 para. 1 lit. f GDPR: Legitimate interest (e.g. improvement of the platform)

7. Disclosure of data to third parties

We only pass on your personal data to third parties if:

• You have given your express consent to this
• This is necessary for the fulfillment of a contract
• We are legally obliged to do so
• It is necessary to protect our legitimate interests

8. Storage of data & data security

1. We only store your personal data for as long as is necessary for the above-mentioned purposes or as required by the statutory retention periods. After the storage period has expired, the data will be deleted or anonymized.
2. We take appropriate technical and organizational measures to protect your data from unauthorized access, loss or destruction.

9. Cookies

Our platform uses cookies. Cookies are small text files that are stored on your device and contain information about your use of our platform. We use cookies to ensure the functionality of the platform and to improve your user experience. You can disable the use of cookies in your browser settings.

8. Text form

1. Declarations to img2geo require an e-mail or a written declaration (fax or letter).
2. Any declaration in text or written form must be sent to the following address: info@img2geo.com

9. Availability of the service

1. img2geo is entitled to change the content of the website, technical elements and the user interface of the service at any time. Such changes may result in users of the portal having to update their software or hardware. img2geo shall endeavor to give reasonable advance notice of such changes. img2geo reserves the right to discontinue the service in whole or in part, temporarily or permanently. img2geo shall endeavor, but is not obliged, to give advance notice of such measures.
2. A claim to the use of the services available on the portal exists only within the scope of the technical and operational possibilities of img2geo.
3. img2geo endeavors to ensure that its services can be used as uninterruptedly as possible. However, temporary restrictions or interruptions may occur due to technical faults (e.g. interruption of the power supply, hardware and software errors, technical problems in the data lines).

10. Final provisions

Should the contract contain loopholes or individual provisions be invalid, this shall not affect the validity of the contract. An invalid provision shall be replaced by statutory law. In the event of loopholes that cannot be closed by law, the contract shall be interpreted in a supplementary manner in accordance with what the user and img2geo would have agreed in good faith as honest contractual partners if they had thought of the unregulated case, taking into account their interests.
